MARINE CORPS DEPENDENCY DETERMINATION AND SUPPORT PROGRAM

Benefits of Dependency (may be authorized depending on member’s eligibility and request)

a)       BAH/OHA;

b)       USIP card; and

c)       Travel allowances.

 

Primary Dependents

Includes:

a)       Lawful spouse

b)       Unmarried, minor children under the age of 21 (includes adopted children, step-children, and children born out of wedlock)

 

Establishment of a Lawful Spouse as Primary Dependent -- 2 Requirements:

a)       Dependency Application (NAVMC Form 10922) (http://www.marforres.marines.mil/Portals/116/Docs/G-1/IPAC/Documents/DEPENDENCY%20APPLICATION%20NAVMC%2010922.pdf); AND

1)       NOTE: Officers may certify entitlement by signing as both claimant and attesting officer, but enlisted members require an officer or administrative personnel with authority to sign as attesting officer.

b)       Certified true copy of license and certificate of marriage from contracted state, with any supporting documentation.

 

Removal of Lawful Spouse as Primary Dependent – 2/3 Requirements:

a)       Dependency Application (NAVMC Form 10922)  (http://www.marforres.marines.mil/Portals/116/Docs/G-1/IPAC/Documents/DEPENDENCY%20APPLICATION%20NAVMC%2010922.pdf); AND

b)       Certified true copies of original marriage certificate and original divorce decree (if U.S. marriage and/or divorce); OR

c)       English translation of marriage certificate and original divorce decree (if foreign marriage and/or divorce); AND

d)       Proof of residency.

 

NOTE ON FOREIGN DIVORCE: A foreign divorce may or may not be recognized as valid by the U.S.

1)       Factors for Determining Validity

i)         Place(s) of residence of parties;

ii)       Whether parties appeared in person; and

iii)      Whether state laws were applied.

 

Establishment of Adopted Child as Primary Dependent – 2 Requirements:

a)       Dependency Application (NAVMC Form 10922)  (http://www.marforres.marines.mil/Portals/116/Docs/G-1/IPAC/Documents/DEPENDENCY%20APPLICATION%20NAVMC%2010922.pdf); AND

b)       Proof of Parentage – adoption decree showing that member is legal parent

 

Establishment of Child Born Out of Wedlock as Primary Dependent – 3 Requirements:

a)       Dependency Application (NAVMC Form 10922)  (http://www.marforres.marines.mil/Portals/116/Docs/G-1/IPAC/Documents/DEPENDENCY%20APPLICATION%20NAVMC%2010922.pdf); AND

b)       Proof of Parentage – EITHER birth certificate with member’s name cited, OR court order citing member’s name, OR signed statement of parentage signed by member; AND

c)       Dependency Statement – Child Born Out of Wedlock Under Age 21 (DD Form 137-4) (http://www.dtic.mil/whs/directives/infomgt/forms/eforms/dd0137-4.pdf) to be completed by custodial parent.

Establishment of Stepchild as Primary Dependent – 2 Requirements:

a)       Dependency Application (NAVMC Form 10922)  (http://www.marforres.marines.mil/Portals/116/Docs/G-1/IPAC/Documents/DEPENDENCY%20APPLICATION%20NAVMC%2010922.pdf); AND

b)       Proof of Parentage – marriage license showing that member is married to child’s legal parent; AND documentation (e.g., birth certificate) showing that the member’s spouse is the child’s parent.

 

Qualifying Secondary Dependents (Title 37, U.S.C., § 401)

 

May Include:

a)       Parents (includes biological parents, parents-in-law, parents-by-adoption, and individuals who stood “in loco parentis” to the member at any time for a continuous period of at least five years before the member attained age of 21)

b)       Full-Time Student Ages 21-22 Years (may qualify until age 23 or graduation, whichever occurs first)

c)       Incapacitated Child over Age 21 (an unmarried child who is incapable of self-support because of mental or physical incapacitation)

d)       Ward of a Court (an unmarried individual who has not attained the age of 21, or age 23 if enrolled full-time in an institution of higher learning, who has been placed in legal and physical custody of the member for a period of at least 12 consecutive months)

 

Establishment of Parent as Secondary Dependent – 4 Requirements:

a)       Dependency Application (NAVMC Form 10922)  (http://www.marforres.marines.mil/Portals/116/Docs/G-1/IPAC/Documents/DEPENDENCY%20APPLICATION%20NAVMC%2010922.pdf); AND

b)       Dependency Statement – Parent (DD Form 137-3) (http://www.dtic.mil/whs/directives/infomgt/forms/eforms/dd0137-3.pdf); AND

c)       Proof of member’s monthly contributions showing that member provides more than 50% of parent’s support; AND

d)       Verification of any income the parent receives (includes wages, retirement/disability payments, state or federal aid, alimony, social security entitlements, etc.)

a.       NOTE: Parent’s income, not counting member’s contribution, must be less than ½ of total monthly living expenses.

 

NOTE – 1 ADDITIONAL REQUIREMENT FOR IN LOCO PARENTIS SECONDARY DEPENDENTS: An In Loco Parentis Affidavit must be completed by the individual who stood in loco parentis of the member (sample on p. 3-11: http://www.hqmc.marines.mil/Portals/61/Docs/HQ%20Svc%20BN/BAH%20Manual%5B1%5D.pdf) .

Establishment of Full-Time Student Ages 21-22 as Secondary Dependent – 5 Requirements:

a)       Dependency Application (NAVMC Form 10922)  (http://www.marforres.marines.mil/Portals/116/Docs/G-1/IPAC/Documents/DEPENDENCY%20APPLICATION%20NAVMC%2010922.pdf); AND

b)       Dependency Statement – Full-Time Student 21-22 Years of Age (DD Form 137-6) (http://www.dtic.mil/whs/directives/infomgt/forms/eforms/dd0137-6.pdf); AND

a.       NOTE: DD Form 137-6 if NOT REQUIRED if member is only trying to claim the student for DEERS enrollment/medical purposes.

c)       Letter from institution of higher education stating full-time enrollment with expected date of graduation on official school letterhead or from National Student Clearinghouse; AND

a.       NOTE: Student must be a full-time student in a course of study resulting in a degree.

d)       Proof of member’s monthly contributions showing that the member provides more than 50% of the student’s support; AND

e)       Verification of any income the student receives (includes support payments, wages, state or federal aid, grants, scholarships, social security entitlements, etc.).

 

Establishment of Incapacitated Child Over Age 21 as Secondary Dependent – 5 Requirements:

a)       Dependency Application (NAVMC Form 10922)  (http://www.marforres.marines.mil/Portals/116/Docs/G-1/IPAC/Documents/DEPENDENCY%20APPLICATION%20NAVMC%2010922.pdf); AND

b)       Dependency Statement – Incapacitated Child Over Age 21 (DD Form 137-5) (http://www.dtic.mil/whs/directives/infomgt/forms/eforms/dd0137-5.pdf) ; AND

c)       Recent (4 months or less) medical or psychiatric evaluation and diagnosis and complete medical summary of illness showing that child’s incapacitation existed before the age of 21 or before age 23 if a full-time student; AND

d)       Proof of member’s monthly contributions showing that the child is dependent upon member for more than 50% of his/her support (if child does not reside with member full-time).

e)       Verification of any income the child receives (includes support payments, wages, state or federal aid, and social security entitlements, etc.).

Establishment of Ward of a Court as Secondary Dependent – 7 Requirements:

a)       Dependency Application (NAVMC Form 10922)  (http://www.marforres.marines.mil/Portals/116/Docs/G-1/IPAC/Documents/DEPENDENCY%20APPLICATION%20NAVMC%2010922.pdf); AND

b)       Dependency Statement – Ward of a Court (DD Form 137-7) (http://www.dtic.mil/whs/directives/infomgt/forms/eforms/dd0137-7.pdf); AND

c)       Certified true copy of a court order from a court of competent jurisdiction in the U.S. or territory of the U.S., granting custody or guardianship of the ward to the member for a minimum of 12 months from the date of the order; AND

d)       Certified true copy of ward’s birth certificate showing that the ward was placed in the member’s custody or guardianship prior to attaining age 21; AND

e)       Proof of member’s monthly contributions showing that the ward is dependent upon the member for more than 50% of his/her support; AND

f)        Signed statement from the member indicating that the ward will actually reside with the member (unless separated by either necessity of military service, to receive institutional care as a result of disability or incapacitation, or such other authorized circumstance); AND

g)       Verification of any income the ward receives (includes support payments, wages, state or federal aid, and social security entitlements, etc.).
